What is happening in this case?
We have learned that a murder trial has been ordered for an Oxnard man accused of killing a good Samaritan while he was driving intoxicated.
The case will be against Francisco Gomez, and the crash happened on July 22, 2018. Two women, Elicia Lopez Troncoso and her daughter-in-law had come upon a Cadillac Escalade that had crashed and was partially blocking the roadway. They stopped and got out of their vehicle to help when a vehicle driven by Gomez struck both of them.
Troncoso was killed in the crash and her daughter-in-law suffered from a serious leg injury.
When police arrived, Gomez had already fled the scene, but they found him injured on the roof of a nearby home. He has pleaded not guilty to all of the charges against him, which include:
- Second-degree murder
- DUI causing injury
- Fleeing the scene of an accident
Due to a previous DUI conviction, he was able to be charged with murder. At the time of the crash, prosecutors say that his blood alcohol level was 24%. That is three times the legal limit.
